Registration of work permit for visa countries

Work permit for the citizens from far-abroad counties shall be executed in a territorial department of the Central Internal Affairs Directorate of the Ministry of Internal Affairs of the Russian Federation after coordination with the employment agency of the information on the number of the employed foreigners, and appropriateness to attract labour migrants.

 

List of required documents

• application for the issue of the work permit to a foreign citizen or a person without citizenship;
• foundation documents of an organization: INN, OGRN, Charter of an enterprise, Extract from the Uniform State Register of Legal Entities;
• color photo 30×40 mm – 1 photo;
• a copy of the document confirming professional education (in some cases it is required to put down Apostille and to make a notarized translation);
• a copy of an ID card (notarized translation);
• the paid state duty (the payment document with bank stamp);
• medical certificates and a certificate confirming the absence of drug addiction, HIV and infectious diseases (chlamydial lymphogranuloma, leprosy, tuberculosis, syphilis, chancroid).

Registration process of work permit for highly-skilled foreign employee

HSS may be attracted if the conditions of his employment in the Russian Federation suggest receiving by him/her the salary in the amount equal to 2 and more million of rubles per year. Income shall be counted before tax, in other words the salary in the contract should not be less than 167.000 rub per month.

This condition is the main criterion for HSS. In the event of employment, the employer himself shall evaluate the competence and the level of qualification of a foreign citizen and bear the corresponding risks.

HSS shall be employed without regard to quota. It is not necessary to obtain a permit for the company (IL) and submit the information to the Employment center.  Thus, only a work permit for a foreign citizen shall be executed. This permit shall be issued for the term of the labour contract, but for no more than for 3 years.

The permit may be renewed unlimited number of times (documents for renewal shall be submitted 30 days before the renewal) but also for no more than for 3 years. The term for execution of a permit for HSS is 21 calendar days as from the date of submission of the documents to the Central Internal Affairs Directorate of the Ministry of Internal Affairs of the Russian Federation.

Attention: in the event of receipt of the original of a personal permit a foreign citizen shall be personally present with passport in the Directorate for Migration Affairs of the Main Directorate of the Ministry of Internal Affairs.

List of required documents

• Petition of the employer;
• Labour contract or independent contractor agreement for performance of works (rendering of services) with the engaged highly-skilled specialist;
• A written undertaking for compensation by the employer of the costs related to possible administrative deportation;
• Certificate of State Registration of a Legal Entity (OGNR) - 1 notarized copy;
• Certificate of Registration with Tax Authorities (INN) - 1 notarized copy;
• Photo 3*4, colored, matte 1 photo;
• The original of the payment order for payment of the fee for issuance of the permit (2,000 rubles per a person);
• A copy of the passport with translation, notarized;
•  Power of Attorney issued on behalf of a legal entity.

Hiring procedure for HSS (highly-skilled specialist)

Stage 1

The organization enters into the labour contract with a foreign highly-skilled specialist which will come into force as of the date of receipt of the work permit. Within 3 (three!) working days it is necessary to notify the Ministry of Internal Affairs of the Russian Federation of the conclusion of the labour contract.

Stage 2

Preparation of the package of documents for submission to the Directorate for Migration Affairs of the Main Directorate of the Ministry of Internal Affairs to obtain the work permit for HSS, subscription of the package of documents by the management of the Company and submission to the Directorate for Migration Affairs of the Main Directorate of the Ministry of Internal Affairs.

Stage 3

The Directorate for Migration Affairs of the Main Directorate of the Ministry of Internal Affairs makes a decision to issue the invitation to HSS for entry to the territory of the Russian Federation and to register the work permit within 14 working days.

Stage 4

On the expiry of 14 days our company receives the Invitation for HSS to enter the Russian Federation. Immediately after this we will contact you and deliver this document. The original of the invitation should be delivered to the applicant.

The applicant (HSS) shall provide the received Invitation to the Consulate of the Russian Federation in the country of his/her residence.

Stage 5

Work permits for highly-skilled specialist shall be issued if the applicant is personally present in the authorities of the Directorate for Migration Affairs of the Main Directorate of the Ministry of Internal Affairs of the Russian Federation.

Our company agrees upon a convenient date and time for receipt by HSS of the work permit. Our staff arrives in the authority of the Ministry of Internal Affairs of Russian and joins the queue in order to let the applicant spend not more than 15-20 minutes to receive the work permit..

Subsequently, the employer shall be obliged to notify the Directorate for Migration Affairs of the Main Directorate of the Ministry of Internal Affairs of Russia of salary accounting following the results of the calendar quarter.
